The Supreme Court of India has issued directions aimed at addressing prison overcrowding and prolonged pre-trial detention across the country. The Court directed all High Courts to constitute dedicated Prison Audit Committees within two weeks and called for detailed assessments of prison capacity, sanitation, medical facilities and the number of undertrial prisoners.
The Bench emphasized that prolonged incarceration without trial can affect the constitutional right to dignity and speedy justice under Article 21.
It also directed authorities to ensure strict compliance with Section 479 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), particularly in cases involving eligible first-time offenders.
The Court further stressed the role of legal services authorities in identifying prisoners who remain in custody because they are unable to furnish bail bonds or sureties. The directions seek to strengthen judicial oversight and improve coordination between courts, legal aid authorities and prison administrations.
